PAYMENT
OF CHILD AND SPOUSAL SUPPORT
Under
California Law, spousal support and child support are payable through a Wage
Assignment. A Wage Assignment is an Order to the employer directing that a certain
sum be deducted from every paycheck issued to an employee who is obligated to
pay child and or spousal support. The Order requires the employer to pay the
support directly to the employee's spouse. A Wage Assignment takes priority
over a garnishment, even if the garnishment was in place before the issuance
of the Wage Assignment. These provisions make it easier and more certain that
the recipient will receive the court ordered child and spousal support payments.
Under current California Law, an employer may not terminate or otherwise punish
an employee whose earnings are the subject of a Wage Assignment!
